The establishment of administrative supervision is an administrative-sanctioning process, that is, a complex activity of competent courts (judges) regulated by administrative procedural legislation to resolve cases of official approval or resolution by a court (judge), as well as recognition by a court (judge) of correct individual, publicly significant administrative-restrictive or administrative-protective decisions and the actions of the public administration. Changing the current legislation by excluding this category of administrative cases from the Code of Administrative Procedure of the Russian Federation will make it possible to more effectively consider the issue of appointing administrative supervision, taking into account the behavior of the supervised person, the crime committed and other significant circumstances, and in addition will allow to redistribute the burden between the judicial and executive authorities.

Согласно действующему законодательству, административный надзор осуществляемое органами внутренних дел наблюдение за соблюдением лицом, освобожденным из мест лишения свободы, установленных судом в соответствии с федеральным законом временных ограничений его прав и свобод, а также за выполнением им обязанностей, предусмотренных законом. Административный надзор, согласно положениям ст. 1 Федерального закона от 6 апреля 2011 г. № 64-ФЗ «Об административном надзоре за лицами, освобожденными из мест лишения свободы»1 (далее Закон № 64-ФЗ), устанавливается для предупреждения совершения поднадзорными лицами преступлений и других правонарушений и оказания на них индивидуального профилактического воздействия в целях защиты государственных и общественных интересов.
