Право на вид в России: история, законодательство и перспективы

Аннотация

Право на вид в России, имеющее свои корни в римском праве, остается недостаточно разработанным в современном российском законодательстве и юридической науке. Целью исследования - определение правового статуса права на вид, его особенностей, способов защиты и гарантий в Российской Федерации. Автор исследует исторические аспекты, законодательные основы права на вид и его эстетическую и экономическую составляющие. Использованы диалектический подход, а также такие методы как формально-юридический, сравнение, анализ и другие. Выводы показывают, что действующее законодательство не предоставляет правовых гарантий на сохранение вида из окна, что подтверждается судебной практикой. Право на вид не имеет отдельного определения и не защищается специальными нормами в законодательстве РФ. Тем временем, актуальность вопросов, связанных с видовыми проблемами, растет с каждым днем. Это подтверждается растущим процессом урбанизации и застройки территорий. Сложившаяся ситуация в контексте реализации данного права указывает на наличие правовых пробелов, что затрудняет защиту интересов собственников. Автор приходит к выводу, что право на вид требует более детального изучения и законодательного регулирования для обеспечения его защиты в условиях современных реалий.
