Accelerated procedures as part of the criminal prevention policy

Abstract
Raised problems of inefficiency of the existing order of consideration of criminal cases, emphasizing problems of the prolonged and slow order that eliminates justice in criminal proceedings. This circumstance is a direct violation of article 6, paragraph 1, and article 9 of the International Covenant on Civil and Political Rights, which proclaims the right to a trial within a reasonable time. To ensure this right, the legislator seeks to amend the simplification of lengthy and slow procedures of criminal proceedings or introduce new simplified forms. Identified two models of simplified procedures in the criminal process: the model of crime control and the model of fair and equal procedure. The practice of applying such models in the USA has been analyzed and the prerequisites for a transition to the balance of these models in European legal systems are considered. Also considered four main groups of the form of simplified procedures: agreements, the procedure for issuance of the certificate of criminal prosecution, mediation and settlement (agreement on admission of guilt).
