Criminal law provision of information security of a smart city as an object of CII

Abstract

Disruption of the functioning of the smart city ecosystem can lead to significant negative consequences, for example, to the shutdown of the city or all industrial enterprises. Smart city information systems are a very attractive target for intruders and are increasingly exposed to various computer attacks. Crimes against the sustainability of a smart city as a critical information infrastructure (CII) cause significant harm to the interests of the state, the citizen, and the smart city as a CII. Currently, this problem is not given due attention, despite the formation of the “institute of responsibility for crimes against the information security of the CII and information processed in the CII”.

The article provides a criminological analysis of crime in the field of computer information for the period from 2017 to 2022. The statistics of computer attacks on a smart city for the period of 2021 and the first half of 2022, and the persons brought to responsibility for committing computer attacks are presented. The negative social phenomena associated with crime against the security and sustainability of the functioning of the CII of a smart city are analyzed. Analysis of statistics on bringing persons to responsibility for crimes committed under art. 274.1 of the Criminal Code of the Russian Federation, allows us to conclude that the largest number of crimes related to causing harm to the CII of the Russian Federation are committed by a group of persons by prior agreement or by an organized group, or by a person using his official position (Part 4 of Article 274.1 of the Criminal Code of the Russian Federation). Prosecution under Part 5 of Article 274.1 of the Criminal Code of the Russian Federation was not carried out in 2021 and in the first half of 2022, from which it can be concluded that, despite the difficult situation in the world, attacks on the CII of the Russian Federation did not lead to serious consequences.

Systematization of information (digital) legislation: current trends (Russia and Central Asia)

Abstract

In the article, the author analyzes the features and current trends in the systematization of information (digital) legislation on the example of the Central Asian states (Kazakhstan, Kyrgyzstan, Uzbekistan). In recent years, in the Russian Federation, the issue of developing a domestic Information or Digital Code has entered the trajectory of transition from doctrinal models to practical implementation. The article emphasizes the role of I.L. Bachilo, who was the first to raise the question of the need for systematization of Russian information legislation in the form of its codification. She argued that despite the lack of formation of the sphere of information activity and the relevant relations that are just emerging, it is necessary to raise the question of codification or complete systematization, and the time for such codification will come sooner or later. Currently, in a number of states located near our country, the development of projects of codified acts in the field of information, information (digital) technologies and information protection has intensified. Further, the article shows the expediency of considering these processes in terms of identifying their main trends, analyzes the approaches to building national information and legal regulation, through the prism of the structure of the projected act, an idea of their content and subject areas is given. At the same time, the article emphasizes that the Russian Federation has its own different experience in preparing codified acts, which should also be in demand in the upcoming codification work. Generalization of the existing domestic and applicable foreign experience, taking into account the law enforcement practice formed in the information legal sphere, seems to be in demand when developing the domestic Information (digital) Code.

The dynamic development of information technology, which currently is taking place all over the world, is changing the existing conditions in the economy and public administration. Borders between countries have not been perceived as a barrier to information and financial flows for a long time, and the mobility of capital and the development of financial technologies have led to the fact that the minimization of taxpayers’ obligations is increasingly taking place in the digital field. New virtual and hybrid business models are being created, the spread of digital goods and services is accompanied by the development of fraud in the field of electronic commerce, and the emergence of startups based on modern technological solutions leads to the invention of shadow digital assets. As a result, the behavior of not only consumers but also professional participants in the turnover, as well as government agencies, is changing.

To the issue of the criteria for protectability of theatrical performance as an object of intellectual property

Abstract

The present study is devoted to the problematic issues of the modern understanding of the essence of a “theatrical performance” as an independent object of copyright, which has the characteristics of an individual protectable composite work. The article analyzes modern approaches to the formation of a single term “theatrical performance” and its differentiation with related terms developed as “theatrical and spectacular work”. The author conducted a systematic analysis of the place of “theatrical staging” in modern Russian intellectual property law, and also identified problematic issues of the multidimensional nature of legal relations within the framework of theatrical activity. In this connection, the article raises the controversial question of who is the person who organized the creation of a complex object, and what legal regime can be applied to such a person.

As a result of the conducted research, the author comes to the conclusion that a theatrical production as a complex object of copyright that meets the criteria of protectability must have an appropriate mechanism of legal protection.

Legal problems in the alienation of rights to a client database

Abstract

The development of information technology has led to a number of important legal issues, including those related to the transmission of client data. Using general scientific methods (analysis, synthesis, etc.), as well as specific scientific methods, namely historical, comparative legal and formal legal, the author seeks to comprehensively investigate issues related to the disposal of rights to the client base.

In order to achieve this goal the author has set the objectives: to study the concept of client base; to consider the specifics of client information protection in foreign legal orders; to identify the conditions under which client information can be recognized as a database; to determine how the rights to the client base and the exclusive right to know-how are connected; to analyze other ways to transfer information about clients.

As a result, the author comes to the following conclusions. First of all, it can be stated that the client base is a valuable asset and is in demand by participants in civil turnover. Analysis of foreign law demonstrates a broad understanding of certain concepts related to intellectual property, which provides more opportunities to dispose of client base rights.

On the basis of the domestic legal regulation, it is possible to consider and dispose of the client base as a database. In addition, information about clients and methods of attracting them, taken into account the commercial value of this information, can in some cases be considered a trade secret. The transfer of client information is also carried out through the conclusion of contracts such as contracts for the provision of services and agency contracts.

The issues of the legal regime of the character and plot-forming objects as independent parts of cinematographic and animated works in Russian and foreign legislation are considered in detail. The problems of control and observance of copyright for audiovisual works in the field of trade are investigated.

The role of artificial intelligence in intellectual property: social and legal problems of creativity

Abstract

The creation of creative products using generative neural networks and other artificial intelligence technologies has become part of the everyday practice of citizens. This phenomenon naturally raised questions about the attitude of users towards works created directly or using artificial intelligence technologies. The massive adaptation of creative tools, enhanced by artificial intelligence technologies, has updated the discussion in the legal community about the nature and mechanics of creativity, the ownership and distribution of copyrights, and remuneration for the use of works created using such tools.

The purpose of this article is to publish and analyze the results of a survey of citizens on the question of their attitude towards creative products that are fully or partially created by artificial intelligence. The research methodology is based on studying respondents’ reactions to questions whose relevance is indicated by scientific literature and the news agenda. The suggested answers represent the most relevant options found in a series of preliminary interviews conducted by organizers with potential voters.

The result of this article was the author’s analysis of the results of the targeted research, which made it possible to detect and generalize sociocultural trends in the attitude of citizens to the creativity of artificial intelligence, mentally construct, and predict their development.

The problem of authority in the use of artificial intelligence systems to create the intellectual property

Abstract

In the article, the author explores the problem of authorship when using artificial intelligence systems to create the results of intellectual activity. The aim of the study is to identify the current state of legal regulation of the studied legal relations and the vision of its development. The author highlights the existing legal status of artificial intelligence systems in the law of the Russian Federation, including a generalization of judicial practice on the topic under study. The author, using a conceptual approach to the work of artificial intelligence, reveals the essence of the phenomenon. Draws attention to the predicted development of artificial intelligence systems. In the work, the author investigates the question of the “consciousness” of artificial intelligence systems, applies an approach from the point of view of quantum mechanics and its interpretations. It is suggested that it is possible that artificial intelligence already has its own “consciousness”, based on the previously indicated approach. There are several types of interaction between a person and a phenomenon that are protected by law when creating RIA. The author also considers the phenomenon from the point of view of imitation of the human brain, through the prism of its characteristics as a non-linear dynamic system influenced by chaos. An example of the growth in the rate of development of artificial intelligence systems is given and a statement is made about the need to take this factor into account in legal regulation. The author proposes a tool for classifying the types of interaction between a person and AIS to determine the scope of protected rights and authorship for RIA: conducting an examination of the operation of systems for the protection of the result of their work as RIA, depending on the amount of interaction to provide such results with protected status. As a result of such examinations, it is possible to single out for the protection of the results not as a RIA, but as a special subject of copyright.
